Ownership of Website; Agreement to Terms of Use
Welcome to kcmcanada.ca, a website of Kenneth Copeland Ministries of Canada (also known as Kenneth Copeland Ministries Canada or KCM Canada) (“KCMC”, “we”, “us” or “our”). By accessing or using our website at kcmcanada.ca, our online store at shop.kcmcanada.ca, or any other website, page or communication service of KCMC that links to these Terms of Use (collectively, the “Website”), you (the “User”, “You” or “Your”) signify that you have read, understand, and agree to be bound by these Terms of Use (“Terms of Use” or “Agreement”). The Website is the property of KCMC and its licensors. BY USING THE WEBSITE, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THE WEBSITE.
KCMC reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use at any time without further notice. It is your responsibility to periodically check these Terms of Use for changes. Your continued use of the Website following the posting of changes means that you accept and agree to the changes. As long as you comply with these Terms of Use, KCMC grants you a personal, non-exclusive, non-transferable, limited right to enter and use the Website.
Purchases made through our online store are also subject to the store’s Terms of Service. If these Terms of Use and the store’s Terms of Service conflict with respect to a purchase, the store’s Terms of Service govern that purchase.
Content
All aspects of the Website, including but not limited to the text, user and visual interfaces, photographs, trademarks, logos, sounds, music, artwork, computer code, sermons, teaching and spiritual educational content (collectively, “Content”), and the arrangement of such Content on the Website, is owned, controlled or licensed by or to KCMC or Kenneth Copeland Ministries (“KCM”), and is protected by Canadian, United States and international copyright laws and various other intellectual property laws.
Except as expressly provided in these Terms of Use, no part of the Website may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way without KCMC’s express prior written consent. KCMC considers framing, the practice of intact reproduction of a page or pages of one website into another website, to be deceptive and a violation of KCMC’s copyright rights. No authorization or permission is given for framing (copying code or layout) of KCMC’s Content, whether in whole or in part.
Your Use of the Website
You may not attempt to gain unauthorized access to any portion or feature of the Website, or to any of the services offered on or through the Website, by hacking or any other illegitimate means. You may not use the Website or any Content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes upon the rights of KCMC or others.
The only permissible use of KCMC’s copyrighted material is that you may download a single copy of any portion of the Content for your personal, non-commercial, informational or other non-public use. You may link to any posting or page on the Website by hyperlinking so as to redirect users to the original article or other content on the Website. No part of the Website may be altered, deleted, reworded, added to or modified in any way.
The Website may contain hyperlinks to third-party websites which are not maintained by, or related to, KCMC. Hyperlinks to such sites are provided as a service to users and are not sponsored by or affiliated with KCMC. The inclusion of any hyperlink to a third-party site does not imply our endorsement of that website. We have not reviewed all such websites and are not responsible for their content. Hyperlinks are to be accessed at your own risk, and we make no representations or warranties about the content, completeness or accuracy of these hyperlinks. Information collected by third parties is governed by their privacy practices. We encourage you to learn about the privacy practices of those third parties.
Prayer Requests, Testimonies and Other Submissions
Prayer requests, testimonies, praise reports and other material you submit to KCMC through the Website are governed by our Terms & Conditions for Prayer Requests, Testimonies and Praise Reports, which are incorporated into these Terms of Use. Please do not submit content that you do not have the right to share.
Text Message (SMS) Program Terms
Program. Kenneth Copeland Ministries of Canada operates the KCM Canada Text Message Program (the “SMS Program”) from our toll-free number 1-833-533-3623. When you join the SMS Program you agree to receive text messages from KCMC that may include ministry updates and encouragement, teaching and devotional content, event and broadcast information, partnership and giving-related messages (including fundraising and donation-related messages), order and service notifications, and replies to prayer, testimony or service requests you have sent us.
Consent. You join the SMS Program by texting a KCMC keyword to 1-833-533-3623, by replying to a text message from KCMC, or by providing your mobile phone number to KCMC and agreeing to receive text messages (for example by phone, in writing or at an event). Consent to receive text messages is not a condition of any purchase or donation. By joining, you confirm that you are the account holder or an authorized user of the mobile number provided and that you are at least the age of majority in your province or territory of residence.
Message frequency varies. The number of messages you receive depends on the campaigns and services you have joined and on your interactions with us.
Message and data rates may apply. Standard message and data rates charged by your wireless carrier may apply to every text message you send to or receive from KCMC. Please contact your carrier for details about your plan.
Opting out. You can cancel the SMS Program at any time. Reply STOP to any message from 1-833-533-3623 and you will be unsubscribed and will receive no further text messages from that number unless you opt in again. If you have joined more than one campaign, replying STOP unsubscribes you from all of them.

Carriers. Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your carrier and network availability. Participating carriers may change from time to time.
Privacy. Mobile phone numbers and text-message consent are handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Changes. KCMC may modify or cancel the SMS Program or any of its features at any time without notice. We may also change the toll-free number the SMS Program uses; if we do, messages from the new number will identify KCMC.
Email Communications
If you provide your email address to KCMC through the Website, our online store or a request for a digital download, we may send you emails of a ministry nature in accordance with Canada’s Anti-Spam Legislation. Every commercial email we send includes an unsubscribe link, and you may withdraw your consent at any time.
Privacy
Your use of the Website is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference. Please review it to understand how we collect, use, disclose and safeguard your personal information.
Disclaimer
The material on the Website could include technical inaccuracies or typographical errors. KCMC may make changes or improvements at any time. KCMC does not promise that the Website or any Content, service or feature of the Website will be error-free or uninterrupted, or that any defects will be corrected, or that the Website or the server that makes it available are free of viruses or other harmful components. KCMC makes no warranties that your accessing the Website, submitting prayer requests online, watching sermons or reviewing spiritual material available on the Website will lead to specific spiritual, physical, emotional or mental results that you may be seeking. KCMC is not responsible for injury or damage to any individual related to or resulting from your or any other person’s use or access of the Website and its Content. Nor is KCMC responsible for injury or damage to the User or to any other person’s computer or device related to or resulting from accessing the Website or downloading materials and Content from the Website.
The Content on the Website is provided “AS IS” and without warranties of any kind, either expressed or implied. To the fullest extent permissible pursuant to applicable law, KCMC disclaims all warranties, including any warranties of accuracy, non-infringement, merchantability and fitness for a particular purpose. KCMC does not warrant or make any representation regarding the use of or the result of the use of the Content of the Website in terms of their correctness, accuracy, reliability or otherwise. KCMC disclaims any and all liability for the acts, omissions and conduct of any third parties in connection with or related to your use of the Website. You assume total responsibility for your use of the Website.
The above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action, including but not limited to the failure to provide specific spiritual, physical, emotional, mental or technical results.
Limitation of Liability
Except where prohibited by law, under no circumstances, including but not limited to negligence, will KCMC be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of, or the inability to use, the Website, even if we have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, KCMC’s liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to KCMC to access or use the Website, but in no case will KCMC’s liability to you exceed CAD $100. You acknowledge that if no fees are paid to KCMC, you will be limited to injunctive relief only, unless otherwise permitted by law, and shall not be entitled to damages of any kind from KCMC, regardless of the cause of action. Because some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, KCMC’s liability in such jurisdictions shall be limited to the extent permitted by law.
Indemnity
You agree to indemnify and hold KCMC, its affiliates, and each of their directors, officers, agents, contractors, partners, volunteers and employees, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable legal fees, arising out of or in connection with your access to or use of the Website, your conduct in connection with the Website, or any violation of this Agreement or of any law or the rights of any third party.
Violation of these Terms of Use
KCMC may disclose any information we have about you (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Website, or to identify, contact or bring legal action against someone who may be causing injury to or any interference with KCMC’s rights or property, or the rights or property of those individuals visiting the Website. KCMC reserves the right at all times to disclose any information that KCMC deems necessary to comply with any applicable law, regulation, legal process or governmental request, consistent with our Privacy Policy.
Governing Law; Dispute Resolution
These Terms of Use and any dispute arising out of or connected to your access to or use of the Website are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law rules. Except where prohibited by law, you agree that: (1) any and all disputes, claims and causes of action arising out of or connected to your access to or use of the Website shall be resolved individually, without resort to any form of class action; (2) the parties will first attempt in good faith to resolve any dispute by mediation, and any dispute not resolved by mediation will be referred to and finally resolved by binding arbitration in accordance with the National Arbitration Rules of the ADR Institute of Canada, Inc. (or, where both parties agree, under the rules of a faith-based Christian conciliation service), with the place of mediation and arbitration being Langley, British Columbia; (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with your access to the Website, but in no event legal fees; and (4) you waive all rights to claim punitive, incidental and consequential damages and any other damages other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. You understand that in accordance with this section you have waived any right to a trial by jury or trial before a judge. If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from the Agreement and does not affect the validity and enforceability of the remaining provisions.
If a dispute may result in an award of monetary damages that could be paid under KCMC’s insurance policy, then use of the mediation and arbitration procedure is conditioned on acceptance of the procedure by the liability insurer of KCMC and the insurer’s agreement to honour any mediation or arbitration award up to any applicable policy limits.
General Terms
1. Severability. If any provision of this Agreement is found by a court of competent jurisdiction or arbitrator to be illegal, void, or unenforceable, the unenforceable provision will be modified so as to render it enforceable and effective to the maximum extent possible in order to effect the intention of the provision; and if a court or arbitrator finds the modified provision invalid, illegal, void or unenforceable, the validity, legality and enforceability of the remaining provisions of this Agreement will not be affected in any way.
2. Entire Agreement. You understand and agree that this Agreement (together with the Privacy Policy, the Terms & Conditions for Prayer Requests, Testimonies and Praise Reports, and, for purchases, the online store’s Terms of Service, each as incorporated) constitutes the entire, complete and exclusive agreement between you and us regarding the Website and supersedes all prior agreements and understandings, whether written or oral, or whether established by custom, practice, policy or precedent, with respect to the subject matter of this Agreement.
3. Amendments to this Agreement. KCMC reserves the right to modify, supplement or replace the terms of the Agreement without notifying you individually. Any changes to the Agreement will be posted on this page with an updated effective date. If you do not agree to the changes, you should stop using the Website.
4. Notice. Kenneth Copeland Ministries of Canada is a Canadian registered charity located in Langley, British Columbia.
